Section 15 Constitution of Pakistan (1973), Article 185 (3) deferred the tenants default payment of monthly rent and the application for sub-letting disposal of premises was dismissed by the rent controller which had no default in monthly rent and premises. Was upheld by the appellate court. The order to search and evict the rent controller was approved, but in the constitutional jurisdiction the High Court restated the order passed by the rent controller, the property tenant was included in the rental agreement against the landlord's written contract. The landlord failed to prove that the tenant was included by the original tenant. The alleged default was erred in view of receipts issued by the resident landlord and before the tenant controller's removal of the rent controller was rejected and the High Court rented controller Supreme Court refuses to take exception to appeal: High Court's leave to appeal re-fuses
