SHABBIR HUSSAIN versus SH. ABDUL JABBAR
A. VIII, R-10 Specific Relief Act (of 1877), failed to file a written statement in section 42, failing to file a written statement which resulted in the right of defense to be filed by the trial court against the trial court's order. Was prevented from filing. Not providing the appropriate time and time for filing an appropriate written statement. The accuracy record showed that the defendants' residence and residence could not be settled as the trial moved, instead of seeking new addresses from the plaintiff, they also issued an order for alternative services. The court did not receive the publication in the newspaper, however, the defendants filed a copy in the presence of the PLA, which was not provided to enable the defendants to file a written statement which justified the delivery of the copy. Without this, the defendants could not be defended, although the usual time was given to file a written statement on the defendants' request. But there was no order requiring them to file a written statement but in these circumstances the petition was allowed.
