Section 302 (b) Constitution of Pakistan (1973), Article 185 (3) appealed against the acquitted accused, according to the FIR, was equipped with 12 bore guns, but there was no recovery from their possession. Delay in registration was not explained, after the High Court High Court dismissed the accused despite the objection of the ocular testimony, neither the evidence of the prosecution nor any fragment of it had been considered, in an unknown decision. No interference was sought, accordingly the complainant was not allowed by the Supreme Court
