To be considered a good ground for non-submission before another court, where the matter was settled, where there were other lawyer's engagements before the High Court, then some alternative arrangements should have been made before the banking court. No representative of the collector was present before the Banking Court. The relevant date was in such circumstances completely justified in dismissing the application for the re-establishment of the banking court. The High Court dismissed the appeal
