MUHAMMAD SHARIF CHATTER versus COMMISSIONER REHABILITATION, AZAD JAMMU AND KASHMIR GOVERNMENT, CAMP MIRPUR
Section 3 Azad Jammu and Kashmir Interim Constitution Act (VIII of 1974), Section 42 (12), Commissioner's powers for hearing on revision matters, restitution of powers contained under section 3 of AJK In use, the Supreme Court appeals to the government. The ordinance, 1952, issued a notification under which the powers of appeal, review and review of restoration matters were entrusted to the concerned commissioner. According to the notification the maintenance commissioner had no jurisdiction to hear the petition filed before. It was said that the commissioners of the respective divisions would be commissioners. Considered as the Rehabilitation Commissioner for the said purposes, the Commissioner of the Division concerned shall decide the application for notification of the notification in accordance with the law in his capacity as Commissioner of the Rehabilitation.
