He should have published a written declaration requiring him to appear in court, on the charge of obtaining his attendance, and after satisfying himself that the accused was fugitive or invisible to avoid execution. The trial court / judicial magistrate's bail should be revoked and the defendants declared guilty on the same day, without adopting a competing procedure. Sec & 87 and, 88, the CCR order which was approved by the trial court was dismissed and the accused was considered on bail with the instruction to surrender before trial and submit a fresh bail. ?
