MEHDI ABBAS KHAN versus SECRETARY; ELECTION COMMISSION OF PAKISTAN, ISLAMABAD
Section 52 Constitution of Pakistan (1973), Arts 199 and 225 constitutional applicants were selected according to the result filed by the Returning Officer, but this resulted in the revised statement of the counting candidate by the Returning Officer. Was reviewed which got more votes. The applicant was declared successful and the Election Commission of Pakistan issued a notification announcing the return of the candidate. The applicant is of the view that the Election Commission of Pakistan could not instruct the Returning Officer to restore the results and could only be ordered to be re-counted, election tribunals were constituted, all matters relating to the outcome of the election should be resolved. Through the Election Election Tribunal, which was framed under Article 225 of the Constitution of Pakistan (1973), the pure question of involvement in this matter could have been better solved earlier in the election. The constitutional petition of the Election Tribunal has been dealt with intellectually. It is observed that the applicant can file an election petition and approach the Election Tribunal in which he can raise all the legal and factual objections raised by him in the constitutional petition.
