And without the legally malicious, fraudulent and misleading statements, the cancellation of the gift was irrelevant because it is believed that the defendant never lost his property to the plaintiff. No reasonable gift was taken. Clearly the case was properly and fairly decided by the courts against the defendants, under which the reviewing courts rejected the circumstances.
