BAZ MUHAMMAD versus THE STATE
Control of Drugs Ordinance 1997, Section 9 (c) Criminal Code of Conduct (V 1 1 \ 898), Section 340 (1) High Court Rules, Volume III, CHAP 24, Part C, Para 1 and 2 Defendants. Did not provide advice. Receiving the trial court case, the trial court did not seek to know if the accused had sufficient means to consult a lawyer for himself, nor did he provide the services of a lawyer for public expenditure. In view of the section 340 required, the CCP read with the rules of the High Court, the trial of the accused III, CHAP 24, RR 1 and 2, on the basis of the evidence in the absence of a lawyer. Was sentenced to life imprisonment. The lawyer was entitled to defense under the law, which resulted in the decision being set aside for violation of the aforesaid provisions of the law, and following the directions of the High Court in C, the case was settled in the trial court. The remand was given. ase
