In his statement recorded under section 497 (1) of the Conduct Rule (XLV of 1860), section 302/34 bail, section 161, CR PC, two witnesses were charged with the murder of the deceased immediately after the incident. After the incident, the accused were removed from their bail privileges; touching on the merits of the case, the presentations made by the accused could not be present at the bail-out stage due to advanced age or physical weakness and inability of the accused. No reasonable basis for the grant was made. There was a reasonable basis for bail to be found guilty of the charge, which falls under the prohibition clause of section 497, CCP Bell was denied in the circumstances.
