SYED AHMED TAIMOUR BUKHARI versus SHUJA-UR-REHMAN KHAN
Section 17 of the Cantonment Rent Restriction Act, 1963, requires the landlord to have personal property. The landlord had two wives and their children, and his first wife and her children were in need of premises. The lawsuit was withheld. But the issue has not been thoroughly reviewed and the landlord's fact remains unclear. The offer of personal necessity in good faith was beyond any doubt as the fact of the oath was consistent with the contents of the claim by which they were ordered to be evicted. Was not illegal and vulnerable and the same was based on authentic and logical reasoning where no misinterpretation of misinterpretation is found on the record, the High Court refused to interfere with the order passed by the Rent Controller. ?
