SHAMAS versus THE STATE
In respect of the Illegal Arms Act (XXI of 1991), Sections 1 (3) 4, 6 and 7 (c) Guarantee, Section 497, notification was issued under Section 1 (3) of the Delivery of Illegal Arms Act 1991. The Illegal Weapons Act, 1991 was enacted in the province, but under Section 4 of the said Act, time and authority were disclosed on which illegal arms surrender was to be made and which notification required Section 7 of the Act. (C) to seek provisions where in the absence of notification under section 4 against the accused and in the case of widespread publicity under section 6 of the Act, no case can be filed against the accused under section 7 (c). In the cases listed under Section 7 (c), the FI rupees, which were without law, were to be filed under the provisions of the West Pakistan Arms Ordinance, 1965 and proceeded through the courts, the matter was under the jurisdiction of the sessions courts.
