Section 302 Constitution of Pakistan (1973), Article 185 (3) against appellant Lalcarra, an appeal against the attempt by the complainant party to retrieve the pistol was alleged by one of the accused while the other accused. It was alleged that the attempt to retrieve the pistol which was snatched by him by the complaining party, the two courts acquitted the accused with the benefit of doubt, where no weakness was identified. The court refused to intervene in a reasonable decision. The prosecution denied the trial court's approval and allowed to appeal the High Court's leave denied.
