SECRETARY TO THE GOVERNMENT OF THE PUNJAB, FOREST DEPARTMENT, PUNJAB LAHORE versus GHULAM NABI
Section 100 Registration Act (XVI of 1908), Transfer of Shelter Belt Area to Sections 17, 18 and 49 of the land, allotment of disputed land was owned by the Provincial Government and the same was given to the Forest Department for planting Shelter Belt. The Board of Revenue, which was allotted for adjustment in its claim, canceled the allotment because the disputed land was not available for allotment because the disputed land department had already been transferred to the Forest High Court under the exercise of constitutional jurisdiction. ? The order of the Board of Revenue and the order to maintain the allotment of the respondents was that the Forest Department could not be deemed to be the owner of the land as no document relating to the property could be brought on record and the transfer of property was subject to the provisions of section 100. Under the Act, 1882, and Sections 18 and 49 of the Registration Act, 1908, the property cannot be transferred to the department where the claim cannot be adjusted against the land in dispute, under the provisions of section 5 of the Property Act 1882. Questions of application and sections 17 and 49 of the Registration Act, 1908 do not arise that the Board of Revenue decided Was. There was no demand for interference in the conclusions disputed by the Board in a comprehensive manner, which led to the Supreme Court setting aside the decision passed by the High Court and consequently the order passed by the Board of Revenue. Retained.
