MUHAMMAD ZIARAT versus STATE
Articles 5/15 and 28 Criminal Procedure (XLV of 1860), sections 302/307/34 of the Azad Jammu and Kashmir Islamic Contempt Laws (Enforcement) Act 1974, were presented in the court on the recording statement of the accused as a defense witness. I said he was a member of the surrounding minority tribe, no one was ready to appear in court as a witness in his defense, he had alleged in the petition that he was called as a witness in his defense. A petition has been requested to appear in court with which to record his own statement. The affidavit was subject to cross-examination by the prosecution, but their application was rejected. Under the Azad Jammu and Kashmir Islamic Contempt Law Enforcement Act, 1974, a person accused of a crime was eligible to appear as a witness in his defense and was allowed to record his statement on oath. In support of the allegations leveled against him, the trial court's order under which the accused's plea was dismissed was set aside and the trial court was directed to record.
