NASEER AHMED versus STATE
Sections 44 and 15 of the Azad Jammu and Kashmir Interim Constitution Act, 1974, terminated the Constitution Request Inquiry Commission's report and filed an FIR under which the Board of Directors, members of the Azad Kashmir Government Co-operative Bank Limited, were running the administration. The Bank has approved the Crop Insurance Scheme in Azad Kashmir. The recommendation of the Secretary Agriculture for the implementation of the scheme in Azad Kashmir cannot be ignored in this regard. The scheme was held in Azad Kashmir without the sanction of the authority authorized by the accused, thus serious, if the scheme was implemented for some personal gain and the bank suffered any loss, then all the members of the board. Should be held accountable for such action. In the nature of the respondent bank, it was appropriate to treat discrimination as the equality clause contained in the Constitution that all the articles of state were equal before the law and the FIR listed in the Commission's Imported Report and its further scope. The AR was postponed under the circumstances and a constitutional application was granted accordingly
