JAM DAD KHAN versus PROVINCE OF PUNJAB

Constitution of Pakistan 1973 Section 9 Constitution of Pakistan (1973), Arts 199, 212 and 185 Civil Service Transfer Civil servant approves the regular hearing, suspension of transfer order, transfer of his constitutional jurisdiction to the High Court Challenged in the High Court. The applicants' position, subject to the notice, was that the transfer of public servants was subject to the terms and conditions of service under which the service was appealed to the Tribunal and all other courts, including the High Court, to have such a case. Entertainment was banned. The complaint was that even though the non-hearing order was approved under the notice, the case did not come up for hearing on the order of the High Court for the last five months. I should move the application better. Raising the objection to the High Court's jurisdiction, the case of our plaintiffs for the recall of the order, thus unable to interfere at the present stage, was denied under the circumstances to appeal to the Supreme Court.
