WAPDA versus LIAQUAT ALI
Employees of the Punjab Essential Articles (Control) Act 1973 Section 17 (1A) Pakistan Water and Power Development Authority (Utilities and Discipline) Rules, 1978, Rule 4 and 5 of the Constitution of Pakistan (1973), Article 212 (3). After serving a notice of removal from them and accusing them of misappropriating / misappropriating government money, the service tribunal sought remand for reconsideration of the case, when employees were found to be ineligible, irregular and corrupt. If action is taken in the matter of, then only Pakistan can be prosecuted against it. Action under the Water and Power Development Authority (Talent and Discipline) Rules, 1978 and Section 17 (1A), West Pakistan Water and Power Development Authority Act 1958, cannot be taken against the employees. In other cases, the court granted leave of appeal to examine the scope and correct import of the provisions of section 17 (1A), West Pakistan Water and Power Development Act, 1958, which was approved in the present application along with the attached appeals.
