He was also dismissed on charges of not filing an action fee against him. In view of the fact that the appellate court was empowered under OLLI, R33, CPC to approve such order / injunction as may be required in this case The power of the court can be exercised by the court, however, as it relates to part of the appeal. It can only be used in favor of all or any of the defendants or parties, although such respondents or parties did not file any appeal or objection, as the challenged demerior was also the overall executor. Against which no decree was passed, therefore, not fatal
