GOVERNMENT OF PAKISTAN versus SARKAR
Land Acquisition Act 1894 Section 54 Limitation AC; (IX of 1908), Section 5 Delays the 334-day ban against the decision of the referee court on the appeal of the increase of compensation by the referee's government for the acquisition of land. To the extent justified, the government claimed negligence by its lawyer in the trial court. Claiming that the government has committed gross negligence to keep itself in touch with the progress of the court, which could result in delays in both the courts. This cannot be termed sufficient within the scope of Section 5, Limitation Act, 1908. The common law claimants would be equal to the government did not specify a delay every day.
