However, the Labor Appellate Tribunal ordered the petitioner's rehabilitation on the basis that after a thorough examination of the material on record, it was found that the applicant was not an employee and the correctness of the restitution of the High Court order. Has been declared separately in an appropriate decision. The evidence on record shows that the applicant was a non-working VA but an officer in the establishment who enjoyed supervisory status when his services were terminated, therefore, he claims. That he is an employee cannot be accepted. The terms and conditions under which the appeal was promoted as an officer were denied under the circumstances.
