KHALID HUSSAIN versus WATER AND POWER DEVELOPMENT AUTHORITY
Pakistan WAPDA Employees (Qualification and Discipline) Rules 1978 R 4 Constitution of Pakistan (1973), Article 212 (3) WAPDA Employees Dispensary Action Penalty and a one-year increment withholding service tribunal Dismissed the appeal which the department filed. When the appeal was delayed by employees more than 2/2 years after the penalty was imposed, the only explanation was that the documents filed by the appellant with him were located in the flood plain. Was in his hometown, so, he was late to file. The appeal was not accepted by the service tribunal and his appeal was dismissed. Even if the employee's village was subjected to flooding for some time, it cannot be believed that he could not be there for 2/2 years, therefore, it was unreasonable to dismiss the employee's appeal within the service limits. Refused in the circumstances
