SAJJADAHMEDJAVEDBHATTI versus SECRETARY,ESTABLISHMENTDIVISION,ISLAMABAD
The Civil Servants Act 1973 Section 18 Civil Procedure Code (v. 1908), Section 12 (2) of the Constitution of Pakistan (1973), Article 212 (3) of the civil servants' former appeal service were dismissed before the Tribunal and the Supreme Court. The Supreme Court also met the failure before a public servant's review request for his seniority. Government employees again contacted the service tribunal under Section 12 (2), CPC, to report their alleged fraud. Could have set aside the first decision / order related to the seniority but no effect on the decision of the service tribunal and the Supreme Court in the preliminary proceedings to refuse to clear it for development in the Grade 19 of the Central Selection Board. I could find no error in the order of the service tribunal or justification of the proceedings after the Supreme Court. ? Section 12 (2), under Government employees, seeks to review earlier orders of the service tribunal under CPC, therefore, no exemption can, thus, be taken on a provisional order approved by the service. Ice, dismissing the tribunal's new plea, would not come in the way of a public servant if he was otherwise entitled to any relief at the department level under the law, his leave of appeal would have been denied in the circumstances.
