RAZIA BEGUM versus SENIOR CIVIL JUDGE (RENT CONTROLLER), CGARSADDA
Section 13 (6) was contested by the landlord requesting the removal of the rental order by the tenant, after filing a written statement by the tenant, the rent controller granted the tenants temporary rent. And directed the simultaneous submission of the Frame Issue under which the order for rent submission and framing of the matter was continuing. On the same date and at the same time, it was illegal and without legal authority because the West Pakistan Citizen Hire Ban was in accordance with Section 13 (6) of the Ordinance, 1959, on or after the first date of hearing and as soon as possible. In rent controller matters, the tenant should be instructed to collect all the rent from him. At the same time, the formation of matters without waiting for compliance with the rent collection order was, thus, contrary to the spirit of the essential provision of law behind the provisions of section 13 (6) of the West. The Pakistan Urban Rent Restriction Ordinance, 1959, was that if the rent-collecting order passed by the controller was not complied with, the court had to strike a tenant's defense of the tenants and immediately pay the rent. In order to pass the evacuation order, there must be a special order detailing the rental rate, collecting specific outstanding rent and regularly collecting the monthly rent from the tenant rent deposit order approved by the Rent Controller. There was no proper and legal order under the circumstances
