MUHAMMAD SADIQ versus NAZAR MUHAMMAD
Article 15 Land Reforms Regulation, 1972 (MLR 115), Para 25 Constitution of Pakistan (1973), Article 185 (3). The case was heard but the respondents' case was pronounced. The order in favor of the applicant was placed on the ground that he had failed to establish his tenancy and the decision was not binding on the appeal of the competing pre-emptor (defendant) applicants, It was dismissed before the Appellate Court and High before the Court of Appeal. It was granted whether the applicant had established his tenancy in some of the underground parts and whether he had previously owned the property. This portion of the land was extended and thus its occupation of the area should not have been disturbed. And whether the courts below misrepresented and omitted to read the documentary evidence and as such were bound to keep the decisions and orders of the courts below.
