The Constitution of Pakistan (1973), Article 212 (3) of the Service Tribunals Act (LXX of 1973), was pending before the Section 4 Service Tribunal for several years to deal with the appeal against the sanitary list and finally the dismissal of the same applicant. Notified of Appeal was filed within 30 days from the decision of the Department of Appeal which was dismissed due to time restriction. It was argued that the applicant will have the option of filing an appeal within 120 days if he does not respond by the date of filing the appeal. It was challenged by the departmental authority and within 30 days from the date of the decision and allowed to appeal the appeal whether the service tribunal properly maintained that the appeal was barred.
