SALEHON versus SARDARAN
Civil Code of Conduct 1908 Section 11 Constitution of Pakistan (1973), Article 185 (3) Res Judeta, in principle applicable ground, was proved non-tribal in the previous case between the parties and the defendant was declared its absolute owner. The finding was finalized and it was also found that the plaintiff did not prove to be the defendant's support, which resulted in the appreciation of the evidence made by the High Court and concluded that the circumstances of the case were judicial. The application of court rules was unimaginable. Section 11, CPC was not applicable because the enforcement of the Muslim Personal Law (Sharia) Application Act, 1962, gave the applicant the latest cause of action, without the plaintiffs' guarantee of interference in such matters.
