The employee was initiated against and was given a mandatory retirement sentence, although the employee, being a station master, was not a government employee approving the jurisdiction of the Tribunal, but under a notification issued by the Ministry of Railways, the station. Some types of railway employees, including masters, were included. The employee designated as a "caretaker", the employee in the caretaker category, was a civil servant and was able to appeal in the light of this situation.
