The decision of the petitioner was decided by the trial court under the decision of consent of the CPC and the adjustment of suit XXIII, C process code order XXIII OXIII, R3 constitution of Pakistan (1973), Article 185 (3). Defendant's statement was made in the interest of the defendants but in the case filed by the respondents, such consent was set aside, the first appellate court rejected the trial court's order and the order of consent was passed by the High Court. Restored, however, the trial court's order restoring the appeal court aside. Idity Val Val Val Val's finding in the High Court was correct that the trial court's decision was more authoritative than the first appellate court's decision. By justifying the High Court to conclude that it did not act, no case was made for intervention, leave to appeal was denied in the circumstances
