RUKHSANA, TUFAIL versus SECRETARY, ESTABLISHMENT DIVISION, ISLAMABAD
Section 4 Civil Servants Act (LXXI of 1973), Section 8 Islamabad Model School for Boys (Service) Rules, 1983, R 11 Civil Servant (Seniority) Rules, 1993, Rr 2, 3, 4 and 7 Employee Sanity Assessment Prior to the selection of the Selection of Selection by the Committee of Employees Serenity was appointed as the Deputy Principals in BPS 18, but the unnamed seniority list issued thereafter showed the employees as teachers. Yet they were never teachers or senior teachers. The seniority was challenged, but their dispute was legal because previous cadre lists were being retained on separate cadre employees, employees claimed that they were directly recruited as vice principal at BPS 18. The integration of their positions into the teachers category was, by definition, abiding by the rules. And Vice Principal's seniority post do not over-generalize the general principles, educational and administrative affairs of the post and cannot serve as the post of E-teacher in which his seniority was proposed while separating seniority as headmistress. Was maintained separately as regards the service cadre of the post, seniority was to be determined and there was no concept of integration of cadre of different categories of staff employees. Being a separate cadre as the Vice Principal and not being integrated with the teachers or the senior teachers, the tribunal accepted the employees' appeal and directed that the seniority list remain as separate as before.
