KHADIM HUSSAIN versus DISTRICT HEALTH OFFICER, MIRPUR, AZAD KASHMIR
In connection with the Government Employees' Health Department of Grade 1 to 4, violating the Rule 2 and 6 Appeal Rules, the government designated the District Health Officer as Authority and the Civil Medical Officer as the Official Officer by notification. According to the notification was given to the District Health Officer as an authority. Only a competent officer can be instructed to prosecute an employee dismissed by a District Health Officer who, after establishing an authority that has sufficient grounds to prosecute the employee, is the authorized officer. Should have been instructed to act against them but instead they would act as empowered officers. Issued a charge sheet to employees
