MUHAMMAD SHARIF versus STATE
The punishment of Pakistan Penal Code Section 304, Part II, was extended under the law to enhance the culprits for injury to the accused in order to save his father and life. The non-recourse to the injury by the accused indicated that it was not actually intended. In such cases, the cause of death of the accused could not have been attributed to death and he was convicted of the crime of murder of the offender under Section 4304, Part II, PPC. He was not sentenced to seven years in prison. A fine of Rs 1,000 by the trial court was also sufficient in the circumstances
