PERVAIZ ELAHI versus PROVINCE OF PUNJAB


The High Court had declared that the first order to dissolve the Provincial Assembly by Governor on the advice of the Constitution of Pakistan 1973 Arts 112, Explanation and 1993 Chief Minister declared that it was without legal authority and had no legal effect on 28 6 1993. Had Within 7 minutes of the High Court's announcement of the order, the Governor had the validity of dissolving the Provincial Assembly, and such an order was found to be a breach of the law as it appears to disappoint the High Court decision. Has been approved. (Dated 28 6 1993) and in view of the findings of the High Court in the preceding case, there was a clear violation of Article 112 of the Constitution, further observing that the applicant abandoned the basic relief of the Provincial Reconstruction. Made a national order and after the opposition leader in the Provincial Assembly withdrew his application before the Assembly which had applied, issued the order without the legal support of the Governor's Decree (28 6 1993). There will be further discussion on the issue of the nature of education.
