SHAHABUDDIN versus THE STATE
Criminal Code of Conduct (CR PC) Section 497 of the Conduct Rule (XLV of 1860), Section 959595/7 77 bail, the bail was denied by the court on the basis that the accused was involved in five cases, for the past two years. There was no indication on detention and there was no indication on record that the accused or any other person acting on his behalf had delayed the settlement of the matter. The trial against the accused was not a death sentence; the prosecution itself did not object to the bail approval of the accused due to legal delay. And it has also been said that hearing only five cases against the accused has no basis to declare him as a baseless, dangerous or felony, in which case the accused was granted bail.
