MAFIA KHATOON versus DISTRICT & SESSIONS JUDGE, KARACHI EAST
The District Judge has withdrawn from the trial court for transfer of the case from one court to another for the purposes of Article 5 and Schedule 12 (2) and 25 of the West Pakistan Family Court Act, 1964. Where it was filed and transferred to a district court judge of another court, the family was not able to move the case from one family court to another, especially when the decision was made by the court. The lawsuit was filed and the order was to be followed.
