The trial court dismissed the plaintiff's case for possession of immovable property in the Constitution of Pakistan 1973 Article 185 (3), but the appellate court upheld the judgment, however, the amendment reinstated the trial court's decision. Questions allowed to consider whether the property in question belonged to the plaintiff or not, was in fact and it was open to the High Court to interfere with the appellate court's finding in the jurisdiction of the affirmation. The second consideration was that the plaintiff had examined the seller as requested by his witness and the defendants that the property in question belonged to the seller's father and that he had inherited it and his brother (the plaintiff).
