The Pakistan Penal Code Ss 304, Part 11 and 302/452/148/149 of the deceased were declared injured while the accused policemen were busy in performing their official duties and hence killing, not the first party. Whether the case against the policemen charged with them, under Exemption 3, clearly falls under section 300, the PPC is a criminal homicide not under Section 304, Part 11, PPC but Section 302, P.P. PC.
