MUHAMMAD ANS versus AKBAR ALI
A. VII R 11 & O XLI, R 1 Appeal for non-payment of reasonable court fees on the affirmation date of the claimant. Where the court found that there was a lack of court fees paid by the plaintiff, such plaintiff was entitled to meet the deficiency. Where the relevant party was not allowed time to appease the deficiency, the order to dismiss the plaintiff for non-payment of appropriate court fees was not in accordance with the law, for the non-payment of reasonable court fees by the appellate court. Was ordered to be dismissed, set aside and the cases were remanded to the First Appellate Court for a first verdict on merit, however, before doing so, the defendants were judged according to the court-evaluated assessment. There will be a fair chance to meet the fee reduction.
