Industrial Relations Ordinance 1969 Section 38 (3A) and 51 Wage Commission Award (1975) National Bank of Pakistan (Staff) Service Rules, 1953 Pension / Gratuity Petitioner, Only Provident Fund was given on retirement at the age of Friday Guard of Bank. But was denied benefit from the pension / gratuity which was payable under the Wage Commission Award Bank, the applicant opted for the old retirement benefit rolls under which the National Bank of Pakistan had to contribute to the Provident Fund. The amount was equal to the amount paid by the employee. The applicant did not choose the old retirement benefit rolls; he was convinced that he had signed the option form without knowing its contents; it cannot be believed that the applicant has filed the favor of the old Country Beverage Provident Scheme. I exercised my authority and accepted it. Under the rules, liabilities cannot claim benefits under the new pension rolls
