Section 302 of the Constitution of Pakistan (1973), Article 185 (3) allowed the appeal for the rehabilitation of evidence in view of the contention of the accused that there was a contradiction between the ocular evidence and the medical evidence. The co-accused, who called the victim effective shooting, was acquitted by denying evidence of eyewitness testimony in connection with the participant's involvement in the case and the interested witnesses were unable to do so.
