HASHMI CAN COMPANY LIMITED versus K.K. & CO. (PRIVATE) LIMITED
Companies Ordinance 1984 Sections 305 and 306 of the Company Judge have the discretion that if they are unable to pay their company loans payout, they may order a company to consolidate and that the loan is payable indebtedness despite the demand of the creditors. The payable disputed amount refers to the dispute between the company and not to those who may be subject to dispute, so when a notice is received under section 306 of the ordinance, the lender immediately disputes the alleged debt. Is informed and the matter is taken to the Supreme Court. Refusal to pay such debts for judicial decision cannot be considered negligent in making payments under 5306 of the Ordinance, where the lower courts, which had the discretion to allow or disallow the company, were unlawful. But did not use their discretion with or with Material. Irregularly, the Supreme Court refused to intervene
