The appearance and absence of the parties to the Civil Procedure Code Order IX of CPC resulted in OI, R 7 prior proceedings, aside, not giving the defendant any specific address of the defendant in the case against a limited company. But neither the name of the person through whom the respondent was being served nor the full address of the defendant was given, summons was sought through the affidavit, no proper service was received by the post. Nevertheless, the court's direction was not affected: the court refused to apply under the OI, R 7, CPC, and the order was dismissed by the former party for material misconduct.
