Requests for registration of trademarks Act 1940 Section 76 Trademarks Rules, 1963, Rr 30, 31, 32, 33 and 35 trademarks were rejected in their early stages without advertisement when other application termination applications. There was no justification for rejecting. A similar advertisement was given earlier that the question of appellant's mark matching with other registered numbers should not have been decided by the registrar at an early stage. And should have been opposed. According to the rules contained in the Trademarks Act, 1940, the owners of registered trademarks were ordered to reject applications for registration of trade marks in the initial stage. This was not guaranteed.
