KARACHI PORT TRUST EMPLOYEES UNION (REGD.) (SHAMMA) versus FEDERATION OF PAKISTAN THROUGH SECRETARY, MINISTRY OF PORTS AND SHIPPING PAKISTAN
Under Section 12 (3) (iv) of the Constitution of Pakistan, Article 199 of the Industrial Relations Ordinance, cancellation of trade union registration by the Registrar, issuing show cause notices to legal requirements and conducting inquiries. Had registered the trade unions of the Registrar of Karachi Port Trust (KPT), the trade union had canceled the registration of the applicants under section 12 (3) (iv) of the Industrial Relations Ordinance 2002 without any further inquiry. Under Section 12 (3) (iv) of the Legal Relationships Ordinance 2002, without giving any show cause notice to the consumer, the Registrar, The cancellation of the yen was authorized, but such power was to be exercised only after inquiry, which was intended to use and supply the mind properly. In the present case, the Registrar of the concerned union was given an opportunity, no inquiry was made to the applicants nor any show cause notice was issued. The constitutional petitions were allowed under the circumstances and the registration of the applicants / union was canceled. The letters issued were to be kept with the instruction that the Registrar is free to act in accordance with trade union law, if any
