MUHAMMAD RAFIQ versus STATE
Section 392 of the Criminal Code (CR PC) and 307 Criminal Code of Conduct (V9 1898), Section 537 of the West Pakistan Arms Ordinance (XX of 1965), Section 13D Joint Trial against two separate FIR suspects. The two cases were registered under the trial and were jointly charged by the trial court and the accused was sentenced in both cases by a joint verdict based on the evidence of the same set of witnesses. Which was not treatable under Section 7 53 Cr, CRPC. And it thwarted the trial and the verdict, which resulted in both appeals being accepted and the sentence dismissed.
