MUHAMMAD ALI versus SIKANDAR HAYAT
Sections 302 and 304, Part II Constitution of Pakistan (1973), Article 185 (3), leave the appeal allowed to consider the reason given by the High Court, whereby the conviction and sentence of the accused is given in section 302, PPC. Section 304, Part II, was changed to PPC. Detailed scrutiny is required to ascertain whether such modification had any legal justification and when the sentence was not approved by law.
