Challenge The applicant was that to protect this loan, he had mortgaged the bank along with some other immovable property with his factory but that the bank had misappropriated the proceeds from its sale. But such a dispute was also raised before the authorities, but after considering the evidence, the High Court was rejected, justifying the interference in finding such fact.
