MUHAMMAD ABBAS versus MUHAMMAD TUFAIL

The impugned order from collection of expenditure within the time discharged by the court for extension of time 35A and 148 has revealed that the petitioner has to certify the order record to collect the expenditure amount with the trial court. The copy was given 30 days from the date of receipt. It was shown that the applicant applied for the certified copy on 12 7 2006 which was provided to him on 26 3 2007. After 5 days have passed to the certified copy applicant, a petition has been filed before the trial court for delay in furnishing the certified copy. This was due to negligence of the office for which the appellant could not be blamed. The applicant was neither negligent nor contradictory in his circumstances.
