Article 185 (3) Appeal for leave to appeal for appreciation of evidence, Appellant's first appeal against the original order of the district court, was dismissed by the High Court because of the timely restraining order to petitioner's counsel. The court was motivated to file an appeal. The gross negligence by filing an appeal without any limitation, after such arguments were submitted to the High Court, was overturned by observation of the facts, before the High Court on the question of appreciation of the facts.
