Section 10/11 Constitution of Pakistan (1973), Article 199 Constitutional petition was to quash the FIR allegation against a male applicant that he had abducted a female applicant who was already married to another person. The alleged kidnapper said he had entered into a marriage contract with the applicant. Marriage with another person was absolutely baseless. The alleged abductor was married to the applicant in her free will, voluntarily and voluntarily, before the woman was allegedly married to another man, not mentioned in the FIR case. Could, however, have been closely examined before. Judge Family Court; where relevant is already taking place, was the best forum to decide whether the alleged marriage with the other person was genuine or a fake, Family Court before both parties went against and against the proposal. The evidence will be free to present, and after a proper investigation of the issue, the Family Court will decide that the parties can present oral and documentary evidence to prove their case so as to justify the termination of the FIR.
